KEEPER FILMS PTY LTD - TERMS & CONDITIONS

These Wedding Terms and Conditions (Wedding T&Cs) constitute a valid and binding agreement between you or the company which you represent (you, the Client) and Ari Lee (trading as Keeper Films Pty Ltd) ABN 19 648 507 322 (we, us, our and Keeper Films). These Wedding T&Cs incorporate Keeper Films Standard Terms, set out at this link.

By agreeing to work with Keeper Films after being made aware of these Wedding T&Cs and the Keeper Films Standard Terms and/or paying a deposit for your wedding, you will be taken to have accepted these Wedding T&Cs and the Keeper Films Standard Terms.

1. STANDARD PACKAGES

If you order the “Short Highlight Package” we’ll provide you with the following:
- maximum of 8 hours shooting time by one videographer
- 4 to 6 minute short film with wedding footage, with shots selected at Keeper Films’ discretion (usually incorporating key moments such as speeches and the ceremony).
- video provided via an online link which allows you to download the full video file.

If you order the “Long Highlight Package” we’ll provide you with the following:
- maximum of 10 hours shooting time by 1 videographer
- 8 to 10 minute short film with wedding footage, with shots selected at Keeper Films’ discretion (usually incorporating key moments such as speeches and the ceremony).
- video provided via an online link which allows you to download the full video file.

2. SPEECHES & CEREMONY ADD-ON

If you order the “Speeches & Ceremony Add-On” you’ll receive a USB or download link with all footage Keeper Films has captured of the speeches and entire ceremony as separate MP4 files. This is a combination of two angles, one static camera placed where reasonably possible in the ceremony venue and reception venue, as well as roaming footage. This includes a maximum of a 45 minute ceremony and 8 speeches. If it’s longer or there are more speeches, additional fees will apply at our usual hourly rate.

However, please note:
- Capturing your full ceremony and speeches in its entirety is a secondary priority to capturing the best shots for your highlights film and while Keeper Films will use its best efforts to capture of much of this as possible, it may be incomplete.
- Unless this add-on is specifically requested at the time of booking, Keeper Films cannot guarantee your full ceremony and speeches will be captured.

3. ADDITIONAL SHOOTER ADD-ON

Our standard packages include one videographer. We may offer to provide you additional shooters. Additional fees will apply if this is required. Keeper Films may recommend this included depending on your schedule or wedding size.

4. OTHER SERVICES

We may offer to provide you a custom packages or add-ons. If we offer to provide this custom package, the scope of our services or deliverables will be set out in the email, quote or proposal under which we provided this offer.

5. TIMING

Keeper Films usually aims to deliver films within 12 - 14 weeks of your wedding. However, this timing is subject to workload and other requirements and it can sometimes take a little longer. If Keeper Films takes more than 24 weeks to deliver your video, you will be entitled to a 25% refund (but this has never happened!)

6. PAYMENT PROCESS

Unless otherwise agreed, the following payment process will apply:

  • -  50% deposit payment required upon booking.

  • -  Remaining 50% required 2 weeks before wedding date

    7. CANCELLING OR RESCHEDULING

Rescheduling: If you would like to change the date of your wedding, you may request a date change in writing to Keeper Films at ari@keeperfilms.com.au. Keeper Films reserves the right to approve or reject your date change request for any reason, including because Keeper Films has a conflicting booking or commitment. If Keeper Films rejects your request, the deposit will not be refundable (as the deposit is provided in consideration for Keeper Films holding the original date for you). If Keeper Films approves your date change request, a reschedule fee of 25% will apply. Keeper may, in certain circumstances, reduce the rescheduling fee in its absolute discretion, including where:

  • the rescheduled wedding is booked on a new date which is between Monday - Thursday; or

  • the rescheduling is due to an event beyond your reasonable control (e.g. a law that prevents the wedding

    going ahead).

    Cancellation by you: Cancellation may be made in writing to ari@keeperfilms.com.au at least 14 days before the date of your wedding, in which case the remaining 50% will not be payable. Otherwise, the remaining 50% will be payable to Keeper Films. Deposits are non- refundable, as they are provided in consideration for Keeper Films holding the date for you.

    Cancellation by KF: Keeper Films will use its best efforts to ensure that, once your deposit has been paid, it does not cancel your booking. Should any unforeseen event arise which requires Keeper Films to cancel, Keeper Films may do so in its discretion by written notice to your email address and will provide you with a full refund of your deposit and any other fees paid by you as soon as possible.

    8. INTELLECTUAL PROPERTY

    Keeper Films retains all intellectual property rights in the services and deliverables it provides you, including your wedding video, all associated footage and audio (Wedding IP). Keeper Films grants you a non-exclusive, royalty free, non-transferable, worldwide and revocable licence to use the Wedding IP to the extent required for you to use, enjoy the benefit of or exploit Wedding IP. Keeper Films may, in its absolute discretion, use the Wedding IP in its portfolio

    To the extent you provide us any content or other intellectual property rights that are included in the wedding video or other deliverables (Content), you (1) grant Keeper Films a non-exclusive, royalty free, non-transferable, worldwide and irrevocable licence to use the Content for any purpose (2) warrant that you have full rights to do so and that the Content will not infringe any third party intellectual property rights and (3) indemnify Keeper Films against any loss Keeper Films suffers arising in connection with your breach of this warranty.

    9. OTHER CONDITIONS

    Travel & Accommodation: Keeper Films reserves the right to charge travel fees if more than 2 hours of total driving time is required from Sydney CBD. Keeper Films may require accommodation and associated costs be covered, with your prior approval.

    Food: A meal is to be provided to each Keeper Films personnel who shoots for 6 hours or more at your wedding.

    Amends: One round of amendments to the main wedding video is included with all packages Keeper Films offers. These amendments must be provided via email within 30 days of delivery of the video. They must in bullet-point form with timestamps, and must require no more than 2 hours work by Keeper Films (as reasonably determined by Keeper Films). Additional time required will be charged at Keeper Films usual hourly rate.

    Quality: Keeper Films usually shoots using DSLR or Mirrorless cameras and records audio using professional microphones and a digital audio recorder. If an audio technician is available, Keeper Films will usually attempt to use a direct line-out from the PA system to record high fidelity audio if this is reasonably possible. While Keeper

Films will use its best efforts to capture high quality audio and video using the methods mentioned above, weddings can be a fast-paced and dynamic environment with lots of moving parts, and Keeper Films may not be able to capture all moments in high quality or fidelity. As such, Keeper Films does not guarantee that all audio or video included in the video will be of a particular quality and will not be responsible or liable to you for failure for the video or audio to confirm to any high fidelity or quality standards.

Videographers: Keeper Films uses a team of experienced videographers who will be allocated to shoot your wedding. You will be allocated a main videographer before the date of your wedding, who will capture the footage on the day. If you purchase the additional shooter add-on, a secondary videographer will also be allocated. Keeper Films reserves the right to change the allocated videographers at any time prior to the date of your wedding for any reason, including due to sickness of an allocated videographer.

Delivery: Keeper Films will deliver the film to you to the email address and/or address communicated by you to Keeper Films and will inform you of this via email. Once you have received the film or footage, you must confirm receipt to Keeper Films of the film within 7 days or, if you have not received the footage, you must let
us know by reply email. If you do not confirm or deny delivery within 30 days, delivery will be taken to have occurred.

Retaining Films & Footage: Keeper Films will only retain copies of your film or footage for 90 days after delivery. After 90 days, the film or footage may be deleted. Keeper Films will have no liability to you for lost film or footage deleted in accordance with this clause.

Shot Selection: Keeper Films will use reasonable efforts to capture the key moments from your wedding, however we do not guarantee the inclusion of any particular footage in your video and will not be responsible or liable to you for failure to include particular footage in a video, include where such footage is lost, missing or damaged for any reason.

Harassment: You must ensure that Keeper Films and their personnel are kept safe and free from harassment at all times during the wedding. In the event that Keeper Films or their personnel experience inappropriate, threatening, hostile or offensive behaviour (whether verbal or physical) from any person at the wedding, the videographer may (in its discretion) request the offending person/s be removed and/or leave the event immediately without refund of payment to you or any further liability to you.

Music: Keeper Films will use music from a royalty-free music library such as MusicBed. All music choices are at Keeper Films discretion, however they will endeavour to use music that suits the tone of your wedding. Please note that licensing restrictions may limit Keeper Films ability to use songs you’ve requested.

Social Media: Unless otherwise agreed in writing, Keeper Films may use your video (or images from your video) on Keeper Films social media pages and website to promote Keeper Films or otherwise for the purposes of professional recognition.

Meetings & Communications: Keeper Films is happy to respond to reasonable phone calls or emails to answer simple questions you may have about our services. However, for any phone calls, emails or face-to-face meetings which require more than 10 minutes of Keeper Films time, Keeper Films reserves the right to charge you at Keeper Films usual hourly rate.

Additional Work: Any additional work required beyond the scope of the services will be charged at Keeper Films usual hourly rate of $100/hour (for admin) and $180 (for shooting and editing).

Liability: To the maximum extent permitted by law, Keeper Films limits all liability to you (including for any loss, damage or otherwise) to the amounts paid by you to Keeper Films. You indemnify Keeper Films against any loss or damage (including personal injury) which Keeper Films suffers as a result of, or in connecting with, performing the services and/or attending your wedding.

ACL: Nothing in this agreement is intended to affect the operation of the Australian Consumer Laws, under which you are entitled to certain statutory warranties and guarantees.
